Terms & Conditions

Please read these Booking Conditions carefully. They constitute the terms on which you enter into a contract with SUNBIRD. They contain some exclusions and limitations of liability. If any part of this agreement is found to be invalid or unenforceable, then the remainder of these Booking Conditions will not be affected and will remain valid and enforceable. In these Booking Conditions, ‘you’ and ‘your’ means all persons named on the booking form (including anyone who is added or substituted at a later date) If there is anything you do not understand or want to know, please contact us before booking.


1) Booking your holiday:


a. To secure your booking, you should complete and sign the Booking Form and send it to us with a deposit of the amount as advised by us at the time of booking and confirmation that you have appropriate insurance cover.

If booking within 04 weeks of departure, full payment is required at the time of booking.


b. On receiving your Booking Form and the requisite payment, we will reserve your holiday and issue you with a Confirmation and Final Invoice. It is at this time that a Contract is made between you and SUNBIRD Journey that is subject to these booking conditions. We will normally confirm your booking within 5 working days although in some cases more time may be required as we will need to communicate with our suppliers. If for any reason we are unable to confirm your holiday and services, we will refund your payment in full.

c. The deposit is part payment of the holiday and full payment of your Final Invoice is due not later than 04 weeks prior to departure. Please note that if we do not receive all payments due (including any surcharge where applicable) in full and on time, we are entitled to assume that you wish to cancel your booking and we shall be entitled to cancel the booking, retain your deposit and apply the cancellation charges as per the cancellation policy.

d. When applicable, your final travel vouchers will be sent to you after full payment deposited and approximately two weeks prior to your departure. If booking within two weeks of departure, documents will be sent to you as soon as possible after full payment, or made available for collection, or sent by courier upon payment of a fee.

e. Special requests should be indicated on the Booking Form or made in writing at the time of booking. Although we will try to arrange for reasonable special requests to be met, we cannot guarantee that they will be, and we will not be held liable if any special request is not met.


f. If your booking is made through a travel agent, we will address all communications to that agent. All payment paid by you to a authorized travel agent under or in contemplation of this contract are held by that agent on our behalf until they are paid to us.


2) Acceptance of booking:

Your booking is only accepted on the understanding that you realize that the destination can be an unpredictable region. We cannot be held responsible for the consequences or effects of flight cancellations, strikes, wars, riots, sickness, quarantine, government intervention, adverse weather conditions, mechanical & electrical breakdown, local political conditions or any other unpredictable or unforeseen circumstances that may have a consequential or material effect on the contents or timing of your holiday.


3) Insurance:

It is a condition of our acceptance of your booking that you take out insurance at the time of booking and it is your responsibility to do so. If you do not have your own insurance please contact with us, we will be able to assist with the most appropriate policy. We cannot be held responsible if you purchase an inadequate insurance policy or if you fail to notify your insurance company of any factors affecting your particular requirements for cover. If you fail to take out adequate travel insurance it will be deemed that you have indemnified SUNBIRD from any consequential loss.


4) SUNBIRD Price policy:

a. Your Confirmation will contain details of what is included in the price of your package. Any items not detailed on your Confirmation are not included in the price of your package.


b. The price of a tour may be varied at any time before we have accepted your booking as all prices are dynamic. We reserve the right to make changes to and correct errors in quoted prices at any time before your holiday is confirmed. We will advise you of any error of which we are aware and of the applicable price at the time of booking. Please note that changes and errors occasionally occur and you must check the price of your chosen holiday at the time of booking.


c. After a Final Invoice has been issued we reserve the right to vary your holiday price in certain limited circumstances. A surcharge will only be levied to reflect increases in transportation costs (including fuel, air fares, increased aviation insurance & security costs), dues, taxes (including a change in VAT), fees chargeable for services (including landing taxes and embarkation or disembarkation fees at ports and airports), government action, or Rate of exchange variations towards International Holidays.


d. All efforts will be made to avoid the imposition of a surcharge, however if imposition is necessary and if the imposed surcharge would increase the total holiday price by 10% or more, you may not cancel your booking after date of issue of our Supplementary Invoice and payments made to us, except for amendment charges previously incurred and any supplementary deposit that was required at the time of booking, else cancellation charge will be applicable.


e. All quoted price by SUNBIRD only which is a total cost of your package include required services, there is no break up cost of package price. Otherwise you can book separately your service.


5) SUNBIRD Payment Policy:

Payment policy mentioned with the particular itinerary. 100% payment should be made before 15 days from your travel date.


6) Amendments & Cancellation:

a. Cancellation by SUNBIRD - We reserve our right to amend or cancel the tour booked by you, without assigning any reason. Such amendment or cancellation may be due to circumstances beyond our control. In such cases, we will offer you alternative tour dates / tours or you would have the option of travelling as individual travelers, not as part of the original tours. If the alternative date / tour is not acceptable or you do not wish to travel as individual travelers, we would refund the money paid by you after deducting any costs incurred by us on your behalf including cruise cost, airlines, transport, permits / visa, insurance, etc. within a period of thirty days from the date of amendment or cancellation. However, we would not be responsible or liable to pay any compensation or damages or consequential loss or interest or to refund any other expense incurred by you.

b. Cancellation by Traveler - Should you wish to cancel your booking, you must notify us in writing. Such notification shall be deemed to have been given to us only on the date of the receipt of your letter. Please state the reason for your cancellation as it may be covered by your insurance policy. Claims must however be made direct to your insurance company.


c. The following Cancellation Charges for the land and airfare packages shall apply irrespective of the reason for cancellation. You understand and acknowledge that these charges are a genuine pre-estimate of the damages that we will suffer on account of cancellation.

In case of cancellation, the following Cancellation Charges would apply (excluding Airline, Cruise, Railway and other transport).


  • Hotel / Accommodation will not change once we reconfirm the room.
  • 50% Cancelation charge will be applicable if cancel after made the booking.
  • 70% Cancelation charge will be applicable if cancel 30 days before travel date.
  • 90% Cancelation charge will be applicable if cancel 15 days before travel date.
  • No refund is allowed if cancellation is made 15 days before travel date.


Towards Air tickets cancelation policy - Airline’s cancelation charge + Rs. 200 per person / per sector for Domestic travel and Rs. 400 per person / per sector for International travel as a cancelation service charge will be applicable.


d. Cancellation of Cruise Holiday:


Charges will be apply as per the Particular Cruise liner’s cancellation policy + 10% Service charge.


7) VISA Rules:


For VISA issuance kindly follow the criteria of the particular country. VISA cost is applicable as per embassy/VFS + Service charge.


8) Booking on offer price:


When you book the tour package in Special offer period, there will be some limitations and restrictions. Kindly check the details at the time of booking.


9) Our scope of services:


We are travel, holiday & tour organizers only. We inspect and select the services to be provided to you.


However, we do not own, operate or control any airline, shipping company, coach or coach company, hotel, transport, restaurant, kitchen caravan or any other facility or provider that is engaged to provide you services during the course of your tour.


10) Meals:


We cannot process a special meal, nor can we guarantee a special diet, nor can we guarantee the seating arrangement in a particular section of the restaurant. We do not assure special meals, or special timings or extra halts for infants, children, or passengers with diabetes, cholesterol, high blood pressure or any other condition.


We cannot guarantee quantity/quality of the food as may be provided by the service provider. If you have any such special requirements arising from medical conditions, customs and practices or from the needs of your children or otherwise, it would be advisable to inform in prior basis. We, however, reserve the right to change the meal arrangement, where circumstances compel us to do so. At some places a meal allowance may be paid at our discretion to you to enable you to have a meal of your own choice.


11) Hotels:

The Company select hotels for your stay at locations, which give comfort and value for money. For various reasons, such as reducing the overall travelling time on the coach for the following day, the hotels may be chosen away from the city center.


Modern facilities such as attached toilets with showers / bathtubs are provided as per availability. We cannot guarantee the availability of adjoining rooms / interconnecting rooms / non-smoking room / View rooms at hills stations and Sea side / rooms on the same floor etc. and all are subject to availability. If you seek a change in rooming while on a tour, the same will be subject to availability and you will need to pay any additional charges as may be applicable. The check in and check out times may vary from city to city. Usually, the check-in time is 12:00 noon and check- out by 10:00 a.m. / Standard check in time 1400hrs & 1200hrs in International Zone. You may have to wait for some time till the rooms are cleared. However, in case the room is required on immediate occupancy/Early check in/Late check out, kindly inform your Tour-coordinator to assist on the same at an additional cost.


Some hotels are refuse to check in unmarried couple as per hotel’s own policy, so kindly inform to your tour coordinator on prior basis at the time of booking.


12) Accommodations:

Single Accommodation:- In case you book on a single occupancy basis, you will have to pay a single room supplement unless another tour participant is willing to share your room. You shall also be responsible / liable to pay the single room supplement if earlier having booked on a shared room basis, you later have to take the room on single occupancy basis since your intended room partner has either dropped out of the tour for any reason or since you and / or your room partner are no longer willing to share a room. And there are maximum hotels provide single rooms are equivalent to double room with same tariff.


Double / Twin Accommodation:- A double room has either a single queen-size bed or two separate beds. If the Client requests for a room with queen-size bed or twin bed, the same would be provided subject to availability as most of the hotel rooms are twin- bedded. In case of non availability of a room with a queen- sized bed, a twin bedded room would be given. In case of non-availability of either of them, the booking will be made based on the availability of the hotel.


Triple Accommodation:- We recommend a maximum of (3) three persons in one room. Triple rooms are usually no larger than twin rooms and the third bed is often a rollaway bed/cot placed in a twin room. Some hotels do not allow a third occupant. And some hotel’s have family room which can accommodate 4 persons but its subject to availability. This however is subject to the concerned hotel policy.


Children Accommodation:- A child travelling for whom 'without a bed' charge has been paid would not be entitled to a separate bed in the hotel. In case 'with bed' charge has been paid for the child and you decide not to avail such facility whilst on the tour, you would not be entitled to any refund. In case you decide to seek an extra bed for the child booked on 'without bed' basis on the tour, this will be provided subject to availability and you shall be bound to pay any additional amount charged by the concerned hotel directly.


13) Transport & Seating:


We generally engage air-conditioned / non-air conditioned luxury coaches / cars, but we are not responsible / liable if the air conditioning equipment malfunctions for any reason. Normally, the air conditioning will not function during hill drives for coaches and cars. On group tours, you are not allotted seat numbers as a seat rotation system is followed. You must follow the instructions of the Tour Manager in this regard.


14) Porterage:


Please note that porterage is not included in the tour price.


15) Baggage in Coach:


It is often difficult to get porters to assist as hotels may or may not provide this service and it is therefore advisable to use bags with wheels. Coaches / cars have limited space for luggage and hence we permit only one suitcase and one handbag per person in the coach for group tours. The suitcase should be of a size of 158 cms. (width + length + height)


Baggage policy of Airline / Cruise:


Kindly follow the Baggage allowance of the Particular Airline / Cruise.


16) Travel Documents:


It shall be solely your responsibility / liability to hold valid and genuine travel documents and statutory clearances, to enable you to travel on the tour such as passports / ID / permits / visa / cruise / train / bus /confirmed tickets / insurance or any other statutory certificates including immigration clearances, etc. In any case, your Passport must be valid for at least six months or as applicable subsequent to the scheduled date of return of the Holiday. The Company would not be responsible / liable in any manner whatsoever for any clerical error made by the concerned Embassy / Consulate regarding name, attachment of wrong photograph, duration and type of visa (single / multiple entry) or passport number.


17) No Refund for Unutilized Services:


It is clearly understood that there shall be no refund or compensation whatsoever for unutilized services. This general rule applies to all kinds of non-utilization or under- utilization of tour services, whether of the whole or part of the tour and some mentioned sightseeing which cost is non refundable and whether as a matter of your choice, or caused by your fault or compelled by circumstances such as ill- health, weather, external factors etc.


18) Liability & Responsibility of the Company (SUNBIRD):


The liability of the company is restricted only to the making reservation in accordance with the traveler’s requirements and no further. Company is not liable for any loss of person or property caused or damaged or suffered by the traveler’s or account of deficiency in services by any independent contractor. Any gesture of courtesy extended by the company to the tourist to minimize such loss or damage will not constitute an admission of such liability or a waiver. The company shall in no circumstances whatever be liable to the traveler or any other person for any loss or expenses incurred due to:


Theft or any other reason whatsoever during the tour and the entire responsibility of taking care of their valuables shall be himself.

Train or flight delays of any reason, rescheduling or cancellation of train/ flights/ cruise / Vehicle interconnection meals. 


Any overstay expenses of any delay or changes in air, vehicle, ship, train or cancellation of special bogie on account of force majeure including weather conditions, strike, war, quarantine, or any other reason whatsoever.


Any personal injury, sickness, accident, loss, delay, discomfort, consequential loss and / or damage or any damage to baggage or personal effects howsoever caused.

Death of the tourist while on tour and all applicable rules and procedures of law are to be followed strictly and all procedures pertaining to the death will have to be tackled and handled by the tourist or their relatives themselves at their own liabilities.

Any injury, loss, personal harm, death or damage caused to any person or property by the act or default of the management or employees or agents of any independent contractor.

Any damages, additional expenses for any consequential losses suffered by the tourist due to cancellation, amendment and or alterations of any of the services of the tour mentioned in the itinerary or brochure by the company after the registration or booking by the tourist.

Any sight seeing missed and/ or the program being curtailed after commencement of the tour and / or before the due period on account of force majeure including any unavoidable circumstances and any reason beyond company control including political riots, natural calamity, Floods, Landslides, closure of monument for any reason, monuments under renovation, VIP movement and security, heavy rush at sight seeing places, road traffic congestion, etc, all the loss or expenses will have to be borne by the passengers.


Any false / obscenities feedback on review page are strictly prohibited, which will be verified with the details. Do not misbehave with any Travel Consultant represented by SUNBIRD. Company (SUNBIRD) has rights to take the action against on the same and has rights to terminate the client's all services by SUNBIRD if its correct proof.


19) Privacy Information:

We try to maintain the privacy of the personal information provided by you. However, it would be necessary for us to share this information with cruise companies, airlines, hotels, transporter and other service providers who would be providing you service during the tour. We would also be constrained to disclose such information if we receive an order of the court, a requisition from any government or statutory authority or where under any laws, rules or regulations, such disclosure becomes necessary.


20) All guest should be read, understood and accepted the Terms and Conditions, Booking Rules, Price, Itinerary, Payment Policy, Cancellation Policy, a copy of each of which has been furnished to me / us and duly authorized by the said persons do hereby agree and accept the same for self and on behalf of the said persons assuming full responsibility and liable to pay the full amount or any applicable cancellation fees before trip start date.
